Prior to and as a condition of being able to access and use Her365 Fitness’s website located at her365fitness.com and associated platform (collectively, “Website”), you are required to consent to the terms and conditions of a written agreement (“Agreement”) with Her365 Fitness. This Refund and Return Policy (“Policy”) applies to refunds and returns associated with the access to and use of the Website. This Policy does not alter in any way the terms or conditions of the Agreement, and in the event of a conflict between the terms of the Agreement and this Policy, the terms of the Agreement shall control.

Memberships

When purchasing Her365 Fitness memberships ("Memberships") or other services, you shall take full responsibility for any loss incurred in the facility to which you are provided access or use. All Her365 Fitness Memberships are twelve (12) months, except as otherwise provided in the Agreement. Memberships begin when you have acknowledged your consent to and electronically signed the Agreement and have otherwise provided all other information and documents required by Her365 Fitness.

Membership Renewal and Cancellation

Memberships must be renewed at the end of the applicable twelve month or other period and shall expire or be terminated solely under the circumstances described in the Agreement, except that new members shall have the right to rescind their Memberships for any reason during the first five (5) days of their initial Membership as further provided in the Agreement. Any time prior to midnight of the 5th business day after the start of the agreement, excluding Sundays and holidays, the Member can cancel her membership. Member is liable only for that portion of the total agreement payment, including processing/enrollment fees and other charges however denominated, that has been available for use by the consumer, based upon a pro rata calculation over the term of the agreement. The remaining portion of the agreement payment will be returned to the Member within 10 business days of cancellation.

Refunds and Returns

All fees and other amounts paid to Her365 Fitness under the Agreement are non-refundable in all events. Returns for Her365 Fitness products and apparel, which may include, without limitation, t-shirts, hats, sports equipment, electronic equipment or other physical or tangible products, will be allowed within thirty (30) days of purchase, with proof of purchase or receipt. Refunds for such products will be in the form of a credit to the purchaser’s credit card.
